How renting works

The basics
of a Spanish lease.

General information for homes rented as a main residence. It is not legal advice; check your contract with a lawyer or gestor.

1

Length

Under Spain's tenancy law (LAU), a tenant renting a main home can keep extending the contract year by year up to five years when the landlord is a private person, or seven years when it is a company.

2

Deposit

The legal deposit (fianza) is one month's rent. In the Balearic Islands the landlord must lodge it with the regional housing institute, IBAVI. Any extra guarantee is capped at two months' rent.

3

Agency fees

Since Spain's 2023 housing law, the agency and contract costs of a residential lease are paid by the landlord, not the tenant.

4

Seasonal lets

Lets of a few months for work, study or a stay that is not your main home are seasonal contracts, with different rules. Short holiday lets need a tourist licence. Holiday rental licences

Once you have a contract, register at the town hall (empadronamiento); you need it for the health card, schools and more. Moving paperwork, step by step
